Stella McCartney is in hot water over the name of her new fragrance StellaNude, but rival brand Nude has failed to take out an injunction to prevent the product's launch.
To be fair to Ms McCartney, she did at least put her name on the scent, but the folks at Nude are still unhappy. The natural skincare brand, co-founded by Bono's eco-entrepreneur wife Ali Hewson, has registered the pan-European Community Trademark for the word 'Nude' to be used for perfumery and skincare. In a press statement, the brand said that a Nude fragrance is "forthcoming".
However, a High Court judge ruled that an injunction would cause damage to Stella McCartney Limited and its licensee, L'Oreal, that outweighed the damage to Nude Brands Limited: "The effect of an injunction wrongly granted against SML would be to cause a massive disruption to their business, and probably cause them to abandon use of the brand altogether."
A trial will take place next year unless a settlement is reached.
